For me the contingent liability for this ATO appeal is quite interesting. I came across the sole purpose test when I worked in big4. It comes down to statutory interpretation and in my experience a literal reading of the legislation was consistent with the policy objective of preventing fund assets being used for the benefit of related parties. Shouldn't be understated that this would be a landmark legal win if DomaCom got up. I can understand why they would pursue this case though. IMO being able to tap into your super would really help (directly or indirectly) a large portion of the market trying to access home ownership. I would also hypothesise that the general public would probably not be as adverse to investing through the platform (compared to fund managers).
