Also, for that definition to apply this would have to be a consumer level product, which it isn’t nor was it ever going to be. The chip is meant to be integrated into other devices, ie. televisions. Considering TV’s already have rubbish speakers, it won’t be difficult (or will it?) for AKP’s chip to meet the average joe’s consumer expectations.

I am saying that you cannot say this MEMS speaker 'works' until its performance is sufficient for integration into consumer devices.
