I actually don't understand the problem of arriving at a decision (by the three amigos).
I understood that the sale by any partners has to be offered in identical terms to all the JV partners at the same time. An A4 page offer is unlikely to be the sale documents that was offered to WPL (and I would bet my leftie on that). So that was a disputable point in itself. Now for the contents.
The "D Relief" is yes or no to FAR's right to PE. If the answer is yes, then what FAR's decision is after that is nobody's business. FAR can say, no we really don't want it, we were out there just there to uphold the contract and be mischievous. Funny it would be, but in theory, can happen.
