If they do not get anything they’ll have 2-3 months before automatic removal from asx. Doubt they’d have time or funds to do a CR. Perhaps they’ll actually get something done for a change. Desperate time call for desperate measures. 

I doubt asic would come to party unless something looked “viable”. But it has happened before, things are said and nothing happens. I doubt they would lie to asic as that could be evidence if any lawsuits were actioned down the track.
