I would imagine Arena would have no problem getting an injunction preventing any payout while legal proceedings were ongoing. Our wonder boys are not the first people in the world to have thought about doing something like this and the courts don't look favourably on people trying to do an end run around them.

I suspect it is more about getting the assets into the hands of Mr Ching for the minimium amount that will prevent NXE going into administration in the short term. Arena will get the cash, Mr Ching the resource, and the shareholders the shaft.
