My personal experience with dealing with the USPTO is it will be a few years before they are granted a patent and there will be a lot of back and forth with the examiner over the claims. I don't think they will have any problem getting a patent, the issue is going to be over the broadness and how easy it will be to work around it.

Patents are less important in biological anyway as it is near impossible to prove equivalence of a generic without going through the whole trial process.
