Justice Foster summed up Lowe's complaint saying it could be "characterised as breaches of contract ... wrongful conduct in a corporate sense and wrongful conduct in purporting to terminate the joint venture agreement in bad faith and on grounds which did not justify the termination".
Justice Lindsay Foster instead ordered both parties enter into arbitration to resolve their differences. Justice Foster also ordered Lowe's to pay Woolworths' costs.
Still no clean air as the Arbitration process still needs to run it's course .
