It has to be paid. Whenever one goes into a JV shareholding you have to share the costs. You cannot operate a mine where one party operates 75% the mine over here and the other 25% other there and you take care of your own costs. I would presume the agreement is pretty clear on the cost obligations. Often in practice there is a quid pro quo that can occur where one party covers it but is paid back in kind in another way. Eg forego their share of production for a period etc, or contra vs some other item. That has not happened here. Now that the company is in Administration, the matter cannot be left unresolved. My view is that CNNC will just pay it etc. If they dont, it is off to get a court order. I would not be surprised to see in the shareholder agreement a provision to recoup unpaid operational costs out of the equity shareholding. The Administrator will do what needs to be done. They have to or they are in trouble.
