It has now been just over 3 weeks since the second hearing. I guess most arbitrators would prefer the parties to make an out of court agreement, but failing that a decision will need to be made.
Given the previous Supreme Ct decision not to hear the case, and the extended period of this arbitration, you would think that the arbitration decision would be binding and no further legal action will result.
there may have already been a 3rd hearing and a 4th one still to come, or it may be it is now decision time. Providing all the facts have been considered, there should not be any appeal case. IMO
