Atlas have, as expected delayed the enevitable and contested the judgement.
I have been asked not to upload the judgement by the party(s) concerned and respect that. I did, however ring the fair work ombudsman myself and although they couldn't discuss the details of it, they did confirm the case. The ABN for Atlas is 74 127647689.

The dispute is about all holiday pay paid to Atlas employees. No annual leave was paid to any field based employee, even those on sallary. Atlas claimed that the holiday pay was paid into the day rate. Atlas could not demonstrate how it was when asked to do so by the ombudsman, because it wasn't.
The ombudsman ruled that the employee(s) were due annual leave and loading.
Atlas have now contested it to buy the some time.
Those are the facts. Take that information as you will, but unless Atlas can demonstrate the impssobile it will be the administrators calling the shots before long.
