Many Aboriginal Reserves are the subject of a proclamation under section
25 of the Aboriginal Affairs Planning Authority Act 1972
Explorers and miners seeking to enter these reserves, if not themselves of Aboriginal descent, must obtain a permit through the DA
A. This obligation (see section
31) is in addition
to the requirement to obtain any permit, tenement or approvals necessary under the relevant Mining and Petroleum Acts. Permits are not usually granted without the prior consent of the Aboriginal Community.
