Yes I highly doubt they would default on the agreement after already paying $5M USD. Also worth noting that the company that is receiving the project has a parent company worth over $2 Billion listed on Shenzen stock exchange as Pfrogy mentioned so I don't think there's too much risk on them defaulting over $3M USD.
