If the pits are currently holding water, has anybody asked where the displaced water is going? Or what plans are to handle rain water once the pits are full?
If the pit water is poor quality (which legacy mine waters usually are) then it will need to be treated before regulators allow discharge to environment. A water treatment plant = CAPEX and OPEX.
It's not a deal-breaker but has anybody asked the questions?
