One cannot ever make a proper decision about the merits of a case from a distance without proper access to the full cases, contentions and responses of both sides, BUT...
IMO and based only of the contentions of the complainant reported in the media article above, this does not sound like an employee working well with his colleagues under the direction of his employer, and if I were to advise him now, I would suggest that his major concern should not be how he will best present his case against TNE, but whether he can afford the cost of putting his case and the financial and reputational consequences of loss.
But as I said, not a well informed view ... just a concern for someone thinking the legal system is a useful weapon for them.
PS I am a shareholder and would hope and expect that my company TNE has acted fairly (so you can probably conclude I have some bias)
