Yes very interesting 101, the first time it's been mentioned on paper as far as I remember. The way I read it, D Day will still be 15th May 2012 Carpentaria is of the view that the anticipated final order (once handed down) will not alter the current contractual obligations of BMG (or a party acquiring BMG’s interest) under the Hawson's joint venture agreement (should that occur)
However, the court concluded (among other things) that BMG should be wound up and that this would be the appropriate order. However, judgment has been reserved for 22 February 2012 when the final orders are due to be issued - might suggest that BMG will need the $13M anytime after 22 Feb.
Ample Source (the Chinese mob who wants CAP's ore and were using BMG as a vehicle to get it) might approach CAP directly or through another company and cough up the $13M to BMG (or perhaps they won't need to, depending on the courts instructions), and also the $25M to CAP, in which case the JV would probably remain the same as it is, the next step being BMG Ample Source beginning the BFS.
I suppose we'll get a more detailed announcement 22 or 23 Feb.
