well nomad wants to claim 4 mill from the joint venture. lets hope they can prove it with their records of all their subcontracts, orders. because with late design changes that means there is a variation to a contract and the variation percentage would be stipulated in the initial contract signed. if 4 mil is just a bogus number or no records. which i reckon it is otherwise tdk wouldnt have brought up theissue. because once a variation order is approved has a certain amount of days before payment is due and if not met. penalties apply...... again tdk would not have brought it up if they saw evidence from nomad. However since nomad is made up of stupid board members who have no experience in building. they probably didnt realise that once a variation order is brought up a discussion should take place as to how it will affect the practical completion date. and because these issues are usually discussed with the seniors management(the board) which in this case would of been pointless. the board members would not have requested an extension in the practical completion date especially if the variation is a critical path in the construction program.
