Robot...I think there is a divide in the interest of the 2 allies in the chameleon side of the case...chm's and the funder's, A binding agreement was entered into and because chm were basically broke the terms upon which the "funding" was obtained were very favourable to the funder, I believe that to be for between 60 to 70% of any possible win, and secured by a $20 million charge over the company to retrieve as much of the costs should there be a loss...Now negotiations have obviously taken place and with the end in sight..ie a settlement or judgement, Interests are divided....The funder may be happy to accept a settlement in the region of lets say $20 mill or so, this result would give the Funder all his costs back plus agbout $12 to $14 mill..The funder would be very happy, a 200% return on thier money in 12 months, and move on..rather than risk a lesser award or a 2 year process on appeal after a higher award....Chm On the other hand, would obviously come out of this with very little...Seeing this chm sought to Sack the funder by doing a behind the scenes deal with Cfe, The idea being to pay off the funder with the $6.5 mill loan from Sage and then keep all of any proceeds from a settlement or award.. Problem is If you do a deal with the devil "the funder" in the first, at this late hour he's not going to walk away with simple return of thier costs....He would have naturally tied chm with binding agrrements and will stick to them...The only way he's going to relinquish his stake is going to be for a settlement with chm, along the lines of costs PLUS an ammount of money that he percieves would have been his cut...So now a couple of scenarios..both I believe not good for chm and thier holders
1/.recievership lifted and deal with sage goes ahead, settlement or award, but A legal battle with "funder" for their cut of proceeds will surely follow...
2/.recievership stands, settlement or award happens but with funder driving it and chm end up with anywhere from a few to $8 million.....
Either way I don't see this as a positive for chm....
So to answer your question I do see chm trading again, but not as a company to invest in...
