Yes you pay tax on the difference of $700,000 note though there is no CGT discount if held less than 12 months as its then treated as normal income AOE is seeking a rule on the DTE shares but unless you are going to sell then I would wait until the ruling is announced note under some ruling having held AOE for more than 12 months will then apply to the DTE shares as an In-Specie distribution IMHO!!
