MMX were pity certain they would win the case, the reason they settled was becasue anything can happen in court, why take even a small risk over 5% of total assets when Koh and Evans were prepared to drop the case for only $5.5m which is nothing , a bit of spare pocket change, for a billion dollar plus comapany like MMX with a lazy $160m in the bank in doesnt even need. If Koh and Evans thought they had a real case they would'nt have taken a lousy $5.5m but gone for the jackpot in court, 5% of assets.
