I read your comments with great interest.
You said "if you loan me $10 without any written agreement and I buy a lottery ticket and win $1m and then refuse to pay you back your $10, would the court say I owe you $10 or $1m? Isn't this the argument here?"
How is it possible that 2 listed companies would not have in place a written agreement? That is either total incompetence or total bull.
I find it hard to believe that any reasonable person (i.e. a judge) would actually believe that two listed companies entered into a loan agreement with no document suggesting the interest rate, repayment schedule and term of loan.
You have only further strengthened my view that this case cant lose once it gets to court.
Finally....remind me never to lend you $10
