Could be the case and very valid points...
I believe though that MMX has come to CHM in the past with an offer to settle, which obviously CHM rejected.
Although we can all offer opinion that 'the case doesn't matter and has no affect on any of the recent happenings', in hindsight it always will as long as the court action exists.
MMX are very aware that CHM want to go the distance and what they want out of it...
Anything that is brought up in mediation can not be offered as evidence or be referred to in the court case, therefore it is more or less a case of delaying, like you say.
However if MMX can ammend an offer which they believe CHM may consider and hopefully take the matter will be over and cleaned up. Leaving MMX with one less negative in possible future merger talks etc.
However as we all know if this occurred CHM will most probably be dumb enough to reject any offer and go for it all. Which will leave them open to the instance you raise EyeOverIt. Leaving CHM with nothing.
We can only hope both parties are smart enough to see the benefits of fast action through mediation. But of course it doesn't seem the directors of CHM have bothered to think that way.
