From my understanding this council of Ministers has the responsibility for Mining Licences and this is delegated to the Minister. All that section says is that the mines department need a Minister to approve their award of the concession.
Read the Mining Concession grant for Battery and this clearly states it is the Minister who signed it on behalf of the government.
