OK - let's assume that AKP received the chips and have commenced testing. Under various likely scenarios:
Scenario 1. Testing not concluded but it's not looking great because further improvements/mods appear necessary: They are in breach of rule 3 in not sending out an update with a negative message to the market when their Feb report paints a positive picture. In fact they are arguably deliberately misleading the market.
Scenario 2: Testing not concluded but things look positive but not 100% validated: They are not in breach of rule 3.
Scenario 3: Testing not concluded but AKP simply doesn't know what the results look like (a worry in itself): They are not in breach of rule 3.
Scenario 4: Testing delayed because chips arrived late: They are in breach of rule 3 because the delay should have been communicated.
Scenario 5: Testing has been completed and the results are either positive or negative: They are clearly in breach of rule 3.
Obviously I'm hoping scenario 2 is the true one!
Are there any other likely scenarios?
