There is no contradiction between

because the TLS does indeed provide for review.
It does not, however, oblige anyone to have a review though and a "convenient review" with an illogical increase in the limit would be such an obvious abrogation of responsibility that it would indeed be "a very foolish politician" who chanced it.
Given that this regulation has been touted by the government as a gold-standard of regulation protecting the public, it would be ridiculous to suggest that this review should take place simply because the industry has proved itself unable to control the seismicity which it causes. It would be even more ridiculous to suggest that any review should allow an increase in the trigger level which has been agreed or 7 years by the industry simply because they can't stop breaking it.
Of course, had they proved able to manage low levels of seismicity I doubt there would have been any objection to a review as provided for in the TLS) and a subsequent gradual increase in the limit. Sadly for Cuadrilla they failed completely here. There will be no upward adjustment as even allowing it at arms length would be politically toxic for a government which can't afford to start fighting new an unnecessary battles.
