Ann: Company Update - ASX Decision to Defer De-listing, page-19

Interesting folk's that if you examine the Listing Rule ( as per below )and as they stand word for word, I bring your attention to the Note highlighted in bold. So it would seem ASX should have just stated the removal would occur on Friday 11th January - since that would have meant the normal Close of Business.

Oversight or just a type ? I guess an error can be made even by the ASX. Under the present ' normal ' wording in the listing rules as against that in the ASX response - The removal was meant to really have meant to be at Close of Business from yesterday - thereby allowing small shareholders and the company ONLY 3 days in effect to digest and form a response. All this while most of Australia is in holiday mode.....



When removal from the official list occurs

17.16 - If ASX's decision to remove an entity from the official list is conditional , the entity, the entity is removed after the conditions are met on a date decided by the ASX. If the decision is unconditional , the entity is removed on the date specified in the decision. If no date is specified , the entity is removed on a date decided by ASX.

this was introduced 01/07/96 and amended 01/07/00

Note : Removal is usually effective from the close of trading on a date decided on by ASX

Example : ASX may require an entity to notify its security holders that it has requested removal and the removal will take place on a set date .
