Nothing should be murky when it comes to shareholder disclosures. If they are not independent fund raisings/agreements, this should be communicate and disclosed to shareholders as the effective cost to shareholders of the loan will not have been properly disclosed otherwise. This would be a reason for shareholders to potentially seek redress through ASIC or through civil action in the case proper disclosures haven’t been made. As mentioned in my previous post I can only assume the raisings and loans are independent arrangements and the equity raising was not a prerequisite of the loan. I’m not even suggesting there need be any undisclosed financial arrangements between funding parties, I’m just suggesting that even if the loan funders told the company that they needed to do an equity raising as a prerequisite for the loan, shareholders should be informed of that.
