By coincidence I received a reply email from Ben at ASX yesterday afternoon, a month after my concerns were sent to him.
In it he said:
"We are writing to confirm that ASX has investigated this matters and has not identified any breach by FMS of its continuous disclosure obligations." (exact words)
I think a full investigation by ASIC is warranted into this debacle.
