I thought (oversimplified) that the basis of the case was that POH had entered into an agreement in good faith to go forward and develop and commercialise and that was not done when Mylan took over. That would mean that it would not come down to Mylan saying it had no commercial legs but to the assumption that it did at the time of the agreement and that POH was effectively duded on any royalties etc.
