I thought this one through a bit more. Basically modelling on different scenarios and outcomes.
I would be the first to say the judiciary and the government (State) are separate. In theory the courts answer to now one but the public they serve in upholding the law and ensuring justice prevails.
I look at the timings of recent weeks. How long has it taken for action to be taken into the ombudsman regarding electoral processes ? When was the complaint logged.
Is the announcement of the police investigation months out co-incidence ?
The judge preceding over the LKO case will be seeing this all. He knows that he hands down his decision now, then the government will no doubt ask for leave to appeal. Judge thinks “bloody politicians”. “Leave me to sort out the mess they create” !!
What if the judge hands down his decision at the beginning of campaigning. Until a government is elected, there isn’t anyone to lodge the appeal. Also if he wants to have maximum political effect he waits until then, just to be sure the electorate realise just how incompetent the current government is ? I’ve studied the law enough to know decisions are reached fairly early as the law is clear. I can only think why now nothing ? The longer this goes on the higher probability this will come just before or during.
If two weeks out of the state election there is no decision, then it’s on. Highly likely this will come mid election. This will be two fingers up at the politicians to remind them the court will can do what it wants, when it wants and serves no politician and no politician should use the law to prevent due process and legitimate claims made.
If there is no decision two weeks out from state elections, i’m buying some more LKO. Besides the fact they will be drilling for gas in SA by this time no doubt.
