I assume this relates to the dispute between nSynergy and livetiles and not the other employee dispute. Both are going to take up a fair bit of management time, and in the derivative suit, nSynergy have received litigation funding - something you won't receive in a claim that is as 'frivolous and without merit'. I wonder how long before we see an announcement stating that the claim has been settled for an undisclosed sum, followed shortly after my a capital raise.
