My understanding is that they are now at step 4 and any appeal to the court of appeal or supreme court must first gain leave of appeal, in as much as the higher court has to agree there is some thing that the lower courts did not consider or a new legal point . This is very different to the pervious steps were any ambit claim can be submitted and the court has to hear it
