It would have to come from the board and be put as a resolution to the shareholders. If the current board don't want to do this then sharks that have taken a position could organise a board spill and vote a new board in.

While liquidation is probably the most sensible thing to do, there is no guarantee that this would take place even if it was. The new shareholders could have other ideas of what they want to do, the one thing we can be pretty sure of is that they won't be concerned with anyone but number one.
