Through Supreme Decree N ° 042-2017, the Ministry of Energy and Mines (MEM) approved the new Environmental Protection Regulation for Mining Exploration Activities, since its objective is to activate this activity from the completion of procedures more accelerated and very well ordered.

To ensure the protection of the environment, which is extremely important, the standard will accelerate processes and improve terms to encourage investment in exploration.

This also ensures compliance with environmental legislation on prevention, minimization, mitigation, rehabilitation and remediation of negative environmental impacts arising from the development of mining exploration; as well as guarantees the effective participation of citizens in the environmental certification procedures related to mining exploration. Thus, it was published on December 22 in the official newspaper El Peruano.

The published standard expressly rectifies the activities of analysis, studies and research related to mining exploration, such as geological, geophysical, geotechnical, geochemical studies, topographic surveys, collection of small amounts of rock and surface mineral samples, they do not request to have an environmental certification before starting, because according to adapt the measures of protection that guarantee the protection of the environment

Likewise, modifications of environmental instruments are shown in the standard, as it ensures that it does not generate impacts, so that they can be processed through a prior communication to the competent authority. On the other hand, it describes that exploration activities that do not generate significant environmental impacts due to their location criteria and number of platforms may apply to an Environmental Technical File. This last instrument is part of the framework of the Environmental Impact Assessment System (SEIA) and will be evaluated by the General Directorate of Environmental Mining Affairs (DGAAM).

To finish, the exploration projects, the regulation explains that with a maximum of forty platforms, they will require an Environmental Impact Statement (EIS), however, exploration projects with more than forty platforms will require a Semidetached Environmental Impact Study (EIAsd).
