If I was the financier or person in the negotiation I would look at the constant repetition of that phrase and think "Christ these people are desperate I'll screw them for the best repayment deal ever" How come I know that and management don't. If these people stuff up and give away a WORLD CLASS resource for peanuts I will be very annoyed and would encourage other shareholders to join me in causing as much trouble as possible for the current board. I am getting more and more suspicious that the Board is doing deals that are not transparent.

Pretty sure that's just a standard run-of-the-mill disclaimer. The company actually sounds reasonably sure the finance will be finalized in coming weeks

And yeh, agree this company is as opaque as hell, no question there. But there's no actual suggestion they're deliberately misleading shareholders or acting against their interests, right?
