THE Ipswich shopper who claims she slipped on a rogue shallot and fell over in Woolworths has asked the court to award her $1.3 million in damages.
Olga Day, 53, an administration staffer from Camira near Ipswich, has sued Woolworths in the Supreme Court claiming she can never work again after falling at the Springfield store on 18 December 2014.
Ms Day states in her claim that Woolworths was negligent when it sold shallots tied together with rubber bands.
“(The band) is cutting the top shoots of the shallots and resulting in spillages ... through the gaps in shopping trolleys and baskets,” Mrs Day claims.
She alleges that Woolworths has “failed to adopt the retail industry practice in (SIC) wrapping the shallots in plastic which extends beyond the length of the shallots, minimising the chance of shallots falling from the bunch and landing on the floor”.
Mrs Day claims the shallots were “on sale” on the day she fell over and the store was busy with pre-Christmas shoppers.
She claims Woolworths was negligent because it “failed to warn” her of “the presence of the loose shallot on the floor”.
