This might be very interesting.

As released on 26/2/2015 the company announced

1.
after careful consideration, is of the opinion is superior to the transaction contemplated by the Metals X; then in the same release

2.
intends, subject to there being no superior proposals, to vote in favour of the NST Transaction and against the Metals X Transaction, in relation to any shares owned or controlled by them.


It then goes on to say in the quarterly report dated 31/3/2015

intends, subject to there being no superior proposals, to vote in favour of the NST Transaction and against the Metals X Transaction, in relation to any shares owned or controlled by them.


I believe that a reasonable person might just decide that the words in the releases are a recommendation.  What might the damages be one wonders?
