Pokerface, again I am not taking one side or the other, but here is the position. There is a dispute between two parties which means both don't agree with each others interpretation. MLX stated they had legal opinion and would likely seek court adjudication, TAM have denied the other parties allegations. The latter needed to respond to let the market know its position. I am reasonably confident that TAM also said they were seeking further legal advice. IMHO TAM needed to advise the market of its initial response, simple. Not surprising it contained what it did.

That doesn't mean that its case over because TAM has stated their case in response to MLX allegation. I reckon if you think TAM's response is all that was needed, I think you should phone TAM and let the BOD know you can shut the case immediately for them.

Seriously, I don't care whether this dispute concludes immediately or takes its course, but to make a comment like TAM wouldn't have released the annt if they wasn't any chance of damages is foolish. On the other hand I don't think MLX will proceed if there was little chance they would receive damages! Perhaps all MLX are doing is being obstructive, but no one will know. One thing for sure if MLX lawyers have a view of success then its likely to proceed it seems.
