Given that there is no previous case law (i think ) for this type of claim it will be very interesting, IMO they could use existing worth of other operations or % of.It must be clear though if the Govt pays just $$$ spent by NTM ,what would stop them doing a similar backflip in the future for any other project? this would not bode well for confidence in the sector. Lost opportunity is an appropriate term and needs to be included in any comp claim as the reason we invest is because of THE opportunity in the 1st place
