My goodness. I am not sure what this rant is about and the 6969 thing, but I will state what I was saying clearly.
The 2 alternatives were an either/or not an and/or. They are mutually exclusive and by their nature must be. They either;
1) have nothing to disclose as the investigation is ongoing
or
2) have something to disclose and have not done so in breach of continuous disclosure
