I don't have any inside knowledge, just putting it all together and I don't think that either party can afford to lose time in the courts.

South American governments are very mining friendly and hence the continent is winning the battle for foreign capital.

Neither of the parties will want a dispute because that will push potential partners away.

They'll want this settled because they can both see opportunities. From my point of view both parties are looking beyond the shoot-out and have their eyes firmly on the future Chinese JV partner.

Time will tell.
