I would suggest that it would be 100% tax free if we lose. The return of the loan is not taxable. The payment (let's say $4M) will be taxable - but I suggest that this would be a capital payment. If this is correct, and taking into account that SRK has spent far more than this developing AF then the ongoing capital loss would easily negate the capital proceeds received ($4m).
