"One landowner has appealed the Minister’s decision in relation to a single title. The
appeal alleges that the Minister misapplied the principles governing statutory
interpretation of expropriation statutes by failing to offer this landowner sufficient
procedural fairness and otherwise failing to interpret the governing statute in favour of
that landowner. This landowner also alleges that the Minister misunderstood the
evidence and rendered an arbitrary decision. The Court has now set the appeal to be
heard on 18–20 February 2013. However a prior hearing, set for 19 November 2012, will
consider (i) whether the appeal should be heard as a trial and (ii) whether the action in
respect of the subject title be stayed until the appeal is heard."
Im just saying amid all these ramps there is need for caution as with out this property the open pit's wall cannot decline 45 degrees making it impossible to dig full depth and therefore making the project unviable.
