THE COURT ORDERS THAT:

1. The appeal to the Full Federal Court of Australia in this matter be expedited.
2. Subject to further order of the Full Federal Court on the appeal instituted in these proceedings, and upon the appellants:
1.1 by their counsel, undertaking to prosecute the appellants' appeal in WAD 80 of 2009 (Appeal) with all reasonable expedition;
1.2 undertaking to pay the respondent such damages or loss whether legally claimable or not as this court or a justice thereof may think just and fair compensation to the respondent for any disadvantage they sustain by reason of this order;
the respondent undertakes not to act on or implement the resolutions passed at the meeting of shareholders of the respondent on 26 March 2009.
3. The costs of the application today be in the cause of the Appeal.
4. The order made by the court on 26 March 2009 that the outcome of the Extraordinary General Meeting held on 26 March 2009 not be published, is now discharged.
