Why do you say the contract superintedent is employed by Heron? A contract superintendent is not a court, it is usually an external party that is independent of both- it is written into these contracts specifically to avoid the courts/legal arbitration. Instead of those steps the contract superintendent arbitrates the decision and it can be binding.
You seem to be clutching at straws here.
