There is no 'fight'............. Section 259D of the Corporations states clearly that a company CANNOT own shares in itself. They must be sold within 12 months.....Who the Police officer is who is enforcing this is irrelevant, the company is currently is in breach of the Corporations Act and MUST comply. PERIOD!
