I think PEN's plan has always been to wait for Wyoming's agreement state status to be approved. Compared to NRC staff, bureaucratic delays will certainly be lessened when Wyoming starts regulating ISL. That said, approval of the first commercial acid leach facility in the U.S. could take some time. Wyoming regulators will be required to demonstrate to the NRC that Wyoming's rules and license conditions are both "adequate" and "compatible" with federal regulations. Since NRC regulations are predicated on alkaline leaching, it is unclear how this process will play out.
