no he hasnt stated he had knowledge of a 249D, he only said he knew of unrest with holders, if he was served with it then yes he had knowledge but if not then it could be argued that the only representation was from a group of unhappy holders and he said he would release a letter to shareholders, which he did and so far as anyone knows this letter did the trick as they havent gone back and served it, so theoretically he has no knowledge of it
