In the event Sheffield is seen to have acted in "Good Faith" the Native Title party will lose considerable leverage in their negotiations with Sheffield.
Remember the judge has only to determine if he believes Sheffield acted in Good Faith. My understanding is there are no other points of law to be considered.
In my opinion it may be prudent for the Native Title party to negotiate a deal prior to any decision.
