I believe Issuing Capacity is set at a percent, either as default by the law or as presented during an AGM and voted on by other shareholders.
Issuing Capacity allows a company to proceed and issue new shares up to the limit, without asking for permission (as they technically already have permission). But they must announce to the market quickly that they have done so.
So no, they must always inform, but they might not have to ask as long as they are within their agreed (or default) issuing capacity.
