I think what SM he is saying is that if a binding contract exists all parties need to honor the part of any conditions precedent.
What people are ignoring here is that a binding contract may exist. If it doesn't go for your life and field bids.
You know if it was that easy, all that TAM directors needed to do was not recommend the MLX deal is taken up and then a week later or so field the NST bid. Somethings up for NST to include in their conditions precedent that the MLX HOA needs to be terminated.
